2025 APEC Ministerial MeetingGyeongju, Republic of Korea | 01 November 2025Joint Ministerial Statement36th APEC Ministerial Meeting 2025Gyeongju, Republic of Korea1. We, the APEC Ministers, met in Gyeongju, Republic of Korea on October 30, 2025, chaired by Minister of Foreign Affairs Ambassador Cho Hyun and Minister for Trade Yeo Han-Koo. We welcome the participation of the APEC Business Advisory Council (ABAC), Association of Southeast Asian Nations (ASEAN) and Pacific Economic Cooperation Council (PECC), as well as the Director-General of the World Trade Organization (WTO) and Secretary-General of the Organisation for Economic Co-operation and Development (OECD). We thank the city of Gyeongju for its warm hospitality.2. We reaffirm our commitment to the APEC Putrajaya Vision 2040 of an open, dynamic, resilient and peaceful Asia-Pacific community by 2040, for the prosperity of all our people and future generations, including through the implementation of the Aotearoa Plan of Action (APA). Under the theme of “Building a Sustainable Tomorrow”, we have advanced the APEC agenda this year through three policy priorities: Connect, Innovate, Prosper, while building upon existing APEC achievements.Connect3. We underscore the importance of strengthening regional connectivity through promoting trade and investment, supply chain resilience, structural reform and people-to-people links to support economic growth and prosperity for all in the Asia-Pacific region. We remain committed to APEC as the premier forum for regional economic cooperation and emphasize the importance of its role in bringing us together to address economic challenges to create a more resilient and prosperous region.4. We recognize the importance of the WTO to advance trade issues. We acknowledge the agreed upon rules in the WTO are key to facilitating global trade. We recognize the WTO has challenges and needs meaningful, necessary and comprehensive reform to improve all its functions to be more relevant and responsive in light of today’s realities. We welcome efforts to deepen discussions in the WTO on contemporary trade issues. We intend to work collaboratively through APEC's role as an incubator of ideas and support Members working together to deliver a successful Fourteenth WTO Ministerial Conference (MC14) in 2026.5. We welcome the entry into force of the WTO Agreement on Fisheries Subsidies and call on remaining economies to deposit their instruments of acceptance as soon as possible, and encourage WTO Members to conclude negotiations on further disciplines to achieve a comprehensive agreement as soon as possible. We recognize the need for constructive engagement on agriculture at the WTO. We also acknowledge the positive role of the WTO Moratorium on Customs Duties on Electronic Transmissions in expanding the digital economy.6. We recognize the positive role of plurilateral negotiations at the WTO, including the Joint Statement Initiatives (JSIs), for advancing issues of interest to Members and to making the WTO more relevant. We note the efforts of participating Members of the WTO JSIs to incorporate the Investment Facilitation for Development (IFD) Agreement and Agreement on Electronic Commerce into the WTO legal framework. We welcome the Statement of the APEC Committee on Trade and Investment, together with the APEC Investment Experts’ Group supporting the IFD Agreement.7. We are committed to strengthening regional trade and investment facilitation, and reinforcement of supply chains. We remain committed to the full and effective implementation of the WTO Trade Facilitation Agreement, recognizing its relevance in an evolving trade environment. We note the progress made to develop a work program for the implementation of the APEC Investment Facilitation Action Plan (IFAP).8. Recognizing its importance to APEC, we reaffirm our shared commitment to advancing economic integration in the Asia-Pacific region in a manner that is market-driven. We support advancing the areas of work identified in the Ichma Statement on A New Look at the Free Trade Area of the Asia-Pacific (FTAAP) agenda in a comprehensive and systematic manner. We instruct officials to begin work on these areas of work in 2026. We welcome continued efforts in implementing and further updating the Capacity Building Needs Initiative (CBNI), aimed at strengthening member economies' readiness to participate in high-standard and comprehensive undertakings. We welcome the Best Practice Guidelines to Apply the Cross-Cutting Principles on Non-Tariff Measures (NTMs), as a practical and enduring resource for APEC economies, which supports economies in developing and implementing NTMs in ways that facilitate trade, advance legitimate policy objectives and drive innovation.9. We acknowledge that global supply chains, as an integral part of global value chains, are facing multiple challenges and we support efforts to ensure that supply chain issues continue to be discussed within APEC to enhance the resilience of supply chains for sustainable economic growth across the APEC region. We encourage greater engagement of the private sector in APEC’s supply chain discussions, including through public-private dialogues. We recognize existing platforms in APEC that promote supply chain connectivity, trade facilitation and digitalization of trade procedures. We underscore the importance of implementing the Supply Chain Connectivity Framework Action Plan, now in its third phase (SCFAP III, 2022-2026), to address supply chain chokepoints in the region.10. We welcome ongoing efforts to strengthen cooperation on standards and streamline conformity assessment procedures across APEC economies. We welcome the “APEC Non-Binding Guidelines for Customs and Cross-Border E-Commerce” and affirm our commitment to balancing the facilitation of legitimate e-commerce trade with robust security measures for high-risk cross-border e-commerce shipments, while advancing customs digitalization to support efficient cross-border e-commerce management.11. We recognize the contribution of connectivity in promoting the prosperity of our region, and note work done in this regard. This includes the APEC Connectivity Blueprint (2015-2025), which was aimed at strengthening, physical, institutional and people-to-people connectivity and will undergo its final review in 2026. We recognize APEC’s efforts in facilitating business mobility and strengthening regional connectivity, including through the APEC Business Travel Card (ABTC). We encourage continuous efforts made to expand fully participating members’ uptake and acceptance of the virtual ABTC, which helps provide an efficient digital tool for supporting business engagement across borders. We also reaffirm the importance of quality infrastructure development and investment. We underscore the role that transportation and tourism play in improving connectivity in the region.12. We recognize the role of the APEC Services Competitiveness Roadmap (ASCR) in supporting effective reform and growth of the services sector in the APEC region. We reiterate the importance of meaningful reforms and cooperative initiatives to achieve an open and predictable environment for an innovative, competitive and resilient services sector. In this regard, we encourage officials to develop an ambitious framework for a post-2025 services roadmap no later than the Ministers Responsible for Trade (MRT) Meeting in 2026. We further encourage cross-fora cooperation between the Economic Committee (EC) and Group on Services (GOS) on structural reform in the services sector. We welcome the completed review of the Reference List on Environmental and Environmentally Related Services and look forward to the next review of the List in 2027.13. We acknowledge that structural reform is essential to boosting efficiency and supporting interconnected growth. In this regard, we welcome the endorsement of the Strengthened and Enhanced APEC Agenda for Structural Reform (SEAASR) at the 4th Structural Reform Ministerial Meeting (SRMM) to guide APEC’s structural reform efforts through to 2030. We also welcome and endorse the Fourth Ease of Doing Business (EoDB) Action Plan and encourage member economies to make concerted efforts to improve the business environment across the APEC region, aiming to achieve the target of a 20 percent improvement in APEC’s EoDB by 2035. We also reaffirm the value of implementing good regulatory practices (GRPs) to foster transparency, predictability and efficiency in the regulatory environment in the APEC region, including by drawing on the GRP Blueprint as a useful guide. We further look forward to the publication of the 2025 APEC Economic Policy Report (AEPR) on Structural Reform to Increase Participation in the Formal Economy and welcome the topic of the 2026 AEPR on Structural Reform and AI-Driven Digital Transformation.14. We recognize the importance of the discussions held at the High-Level Dialogue on Cultural and Creative Industries (CCIs). We affirm the significance of CCIs as a powerful and emerging driver of growth, and affirm the importance of robust intellectual property protections. We also acknowledge that the process of creation, production, distribution and consumption of CCIs is rapidly evolving due to technological advances. We note the value of CCIs as it contributes to fostering economic growth in the APEC region, as well as preserving cultural heritage, both tangible and intangible. Further, we note its value in encouraging tourism as well as economic, cultural and people-to-people ties, and better understanding and mutual respect among member economies within the APEC region.Innovate15. We reaffirm our commitment to working to ensure that the benefits of digital transformation are accessible to all including by bridging digital divides, improving digital connectivity and supporting the digital ecosystem with the aim of strengthening the economic competitiveness of the Asia-Pacific region.16. We recognize the important role of the digitalization of the economy as a driver for innovation, productivity and economic growth across the region. We look forward to the continued implementation of the APEC Internet and Digital Economy Roadmap (AIDER)’s objective beyond 2025 in a way that addresses emerging opportunities and challenges in the rapidly evolving digital landscape. We recognize the importance of exploring the way forward on a progress review on AIDER. We encourage economies to strengthen affordable and resilient digital infrastructure, and capacity building, accelerate interoperability and enhance digital literacy and skills to facilitate digital transformation. We recognize the increasing importance of data for the digital economy. We will continue our cooperation on facilitating the flow of data and strengthening business and consumer trust in digital transactions. We also note with concern the rise of online scams across the Asia-Pacific, which may harm our digital economy.17. We note the benefit of digitalization to enhance and facilitate trade. We remain committed to promoting the cross-border recognition of electronic trade-related documents, including electronic bills of lading and electronic invoices, and enhancing the facilitation of paperless trade in our region, including through capacity building initiatives. We recognize the benefits of public-private collaboration in catalyzing the paperless trade transformation. In this regard, we welcome the establishment of the APEC Centre of Excellence for Paperless Trade (ACCEPT), which aims to strengthen collaboration between the public and private sectors, including ABAC and other interested stakeholders, to advance paperless trade in the region.18. We are committed to strengthening the protection and enforcement of intellectual property rights, including through continued efforts to address challenges posed by online piracy, counterfeit goods and misappropriation of trade secrets.19. Recognizing the importance of innovative technologies, we acknowledge that advancements in science and technology can contribute to addressing challenges and emphasize the importance of strengthening Science, Technology and Innovation (STI) capacity in the APEC region. We reaffirm that such capacities can be enhanced through collaboration and partnerships in a mutually beneficial way, including through the appropriate and voluntary exchange of scientific talent such as the Scientist Invitation Program. We recognize that expanding research and development collaboration and supporting innovative ecosystems and start-ups have the potential to play a vital role in advancing shared goals and enhancing the value of innovation and technologies. We welcome the Republic of Korea’s efforts to host Digital Week and the inaugural APEC Digital and AI Ministerial Meeting.20. Recognizing that artificial intelligence (AI) is having a profound impact on economies worldwide, we reiterate that AI has become an important tool for driving innovation, competitiveness, productivity and economic growth and transforming various aspects of daily life across the Asia-Pacific region. In this regard, we commend the APEC work this year to support economies to maximize opportunities brought about by AI by advancing successful AI transformation, building AI capacities at all levels and cultivating an investment ecosystem for resilient AI infrastructure.21. We also recognize the potential of AI to reshape international trade. We acknowledge the importance of adopting AI-enabled procedures that contribute to trade facilitation, particularly in enhancing customs procedures. We encourage economies to share domestic approaches to relevant AI-related policies with the private sector and discuss opportunities for voluntary exchanges on trade-related AI standards and technologies. In this regard, we will continue discussions on the use of AI in cross-border trade within APEC with a focus on practical cooperation and capacity building.22. We note the importance of flexible and vibrant labor markets and responding to future jobs through dynamic and active labor market policies that provide robust protections for all workers and promote access to high-quality, well-paying and full employment opportunities for all. We recognize that it is critical that labor market systems respond to changes resulting from the rapid emergence of new technologies, such as AI. We reaffirm our commitment to modernizing human resources development, promoting lifelong learning programs and working towards and strengthening high-quality and sustainable social safety nets that encourage workforce participation and support workforce training, reskilling and upskilling.23. We recognize APEC’s efforts to integrate digital technologies, including AI, into education to foster innovative learning environments. To this end, we affirm the need to strengthen education cooperation and networks, including through public-private partnerships, expand access to and use of digital learning resources and ensure accessible and affordable educational opportunities for all.24. We appreciate the discussions on promoting innovation to enhance productivity, advancing digital finance in response to rapid digital and AI development and discussing fiscal policies. In particular, we welcome the endorsement of the Incheon Plan under the APEC Finance Ministers’ Process at the 32nd APEC Finance Ministers’ Meeting, which is structured around the pillars of innovation, finance, fiscal policy and access and opportunity for all.Prosper25. Amid increasing global challenges, the impact of extreme weather events, wildfires, outbreaks, disruption in food supply chains and demographic changes on the region, we recognize that collective responses are needed to effectively address these shared issues. We also recognize progress in bolstering disaster risk reduction and response capabilities, but emphasize the importance of scaling up APEC-wide action to address an evolving risk landscape.26. We intend to develop the APEC Ocean Resilience Enhancement Roadmap, as discussed at the APEC Ocean-Related Ministerial Meeting, to strengthen the resilience and disaster response capacity of marine and coastal communities. We emphasize the importance of efforts to ensure the conservation and management of oceans resources, address marine debris and its impacts, strengthen capacity building and ocean literacy, combat illegal, unreported, and unregulated (IUU) fishing and maintain strong APEC ocean and fisheries-related cooperation. We acknowledge the critical importance of the Port State Measures Agreement to the sustainability of fisheries resources and the livelihoods of those that depend on those resources. We recognize the essential role of fisheries and aquaculture in contributing to global food security.27. We reiterate the importance of strengthening food security in the region by fostering productive, resilient and innovative agri-food systems through the efficient use of agricultural resources, recognizing there is no one-size-fits-all approach. We recognize the critical role that trade can play in achieving food security, minimizing agri-food supply chain disruption and promoting open, fair, transparent, productive, resilient and innovative agri-food systems that benefit all. We support efforts to reduce food loss and waste, promote innovations in agricultural biotechnology and note the importance of strengthening everyone’s capacity to participate meaningfully in food systems, across all levels to achieve safe, nutritious and sufficient food for all to ensure food security in the region. We acknowledge the importance of fostering science-based cooperation to address current and emerging risks to food systems. In this regard, we remain steadfast in our efforts to take concrete actions to strengthen food security, and recall the APEC Food Security Roadmap Towards 2030.28. Witnessing a profound shift in demographic compositions across the Asia-Pacific region, particularly declining birth rates, population aging and accelerated urbanization, we underscore the importance of addressing the long-term economic challenges and optimizing opportunities from these demographic changes. In this regard, we welcome APEC’s work this year on exploring collaborative responses to demographic changes. We further acknowledge the impact of demographic changes on younger generations and emphasize the importance of empowering and equipping them with the necessary tools to build a resilient and prosperous future. In this regard, we welcome the APEC Sub-Fund (ASF) on Prosperity of Future Generations.29. We recognize the importance of ensuring that the benefits and opportunities of economic growth are enjoyed by all in the Asia-Pacific region. In this regard, we take due note of APEC’s past and ongoing work to foster an environment for resilient economic growth, promote economic empowerment of all and strengthen peoples’ participation in regional and global markets, including through capacity building activities and dialogues.30. We recognize that addressing APEC economies’ energy challenges, including energy security and accessibility, will require the use of available energy sources and technologies, together with advanced energy storage, power grid and energy efficiency solutions, in line with domestic circumstances and priorities. We note the rising demand for electricity across the APEC region, and recognize the need to ensure a stable power supply, in accordance with each economy’s domestic circumstances and priorities, noting the role of market-based instruments, such as power market design and energy attribute certificates. We acknowledge the important role that natural gas and LNG can play in providing sustainable, secure, affordable and reliable energy as well as flexibilities in our respective energy systems. We encourage member economies to create favorable conditions for energy-related trade and investment. We also recognize that enhancing grid energy infrastructure, including energy storage systems, microgrids, smart distribution networks and subsea power cables and deepening regional interconnectivity can foster more efficient and reliable grids to strengthen energy security and energy accessibility across APEC economies. We note discussions on renewable energy and energy intensity. We emphasize the innovative potential of AI and encourage its adoption across the energy sector, noting the need to meet demand for data in an energy and resource efficient manner that benefits all. Through these efforts, we aim to support the sustainable development of balanced, affordable, reliable, secure and innovative energy systems and deliver benefits, including job creation and regional economic development while respecting each economy’s domestic circumstances and priorities.31. We reaffirm that MSMEs are engines of economic growth and recognize that a favorable business environment, including through MSMEs’ effective utilization of AI and digital technologies, helps drive MSMEs’ innovation, growth and competitiveness. We reiterate the need for enhanced connectivity and collaboration, including public-private collaboration and other stakeholders, as appropriate, to foster an enabling environment and innovative ecosystem for MSMEs. We welcome approaches to fostering MSMEs’ and startups development, including through enhancing supply chain networks, promoting access to financing, promoting collaborative innovation, removing regulatory barriers and establishing connections with large companies to support MSMEs’ growth and integration into global markets. In this sense, we note APEC’s efforts to foster MSME advancement, such as through the Lima Roadmap to Promote the Transition to the Formal and Global Economies (2025-2040). We also welcome the Jeju Initiative on APEC Start-up Alliance, as endorsed at the 31st APEC Small and Medium Enterprises Ministerial Meeting.32. We reiterate our commitment to building resilient, accessible and age-responsive high-quality health systems and improving health for all. We recognize the importance of integrated, community-based primary health and care systems. We acknowledge the transformative potential of digital health and AI to improve patient-centered health, service delivery, early detection, diagnosis, treatment and health outcomes. We support joint efforts across sectors to build and improve coordinated multisectoral surveillance systems and early warning systems for health emergencies to address the interdependence between human, animal, plant health and the wider environment. We support collaborative efforts to enhance comprehensive cancer control throughout the life course and engagement of member economies in voluntary knowledge exchange and best-practice sharing, as discussed at the High-Level Meeting on Health and the Economy.33. We welcome discussions on mutual legal assistance, ways to strengthen information sharing among competent authorities, and utilizing digital technology to combat cross-border corruption crimes and will further facilitate the implementation of the United Nations Convention against Corruption (UNCAC). We take note of the role of multi-stakeholder engagement in preventing and combating corruption, such as domestic and foreign bribery, including through the APEC Network of Anti-Corruption Authorities and Law Enforcement Agencies (ACT-NET), as well as strengthening corporate integrity and whistleblower protection. We underscore the importance of anti-corruption training education and technical assistance across both the public and private sectors. We recognize the role corruption plays in facilitating other crimes, including organized crimes. We also reaffirm our commitment to denying safe haven to corruption offenders and illicit assets. In this regard, we acknowledge the importance of the Beijing Declaration on Fighting Corruption and Santiago Commitment to Fight Corruption and Ensure Transparency.Strengthening APEC as an institution34. We reaffirm our commitment to strengthening APEC as the premier forum for regional economic cooperation and remain committed to APEC’s mission and its voluntary, non-binding and consensus-building principles. We emphasize the importance of APEC’s role in bringing economies together to address the economic challenges facing our region and create a more resilient and prosperous Asia-Pacific region. We also recognize the importance of cross-fora collaboration within APEC, and encourage outreach and engagement with the business community and relevant stakeholders.35. We express our appreciation to all APEC Committees, Working Groups and sub-fora, as well as the APEC Secretariat and the Policy Support Unit (PSU) for all their work and contributions in 2025. We approve the 2026 APEC Secretariat Account Budget and corresponding level of Members’ Contributions for 2026. We welcome the Budget and Management Committee’s ongoing consideration of APEC financial management and sustainability issues. We also thank members for their contributions including support for Secretariat operations, as well as provision to general and specialized project funding. We will continue efforts to promote efficiency as well as ensure sustainable staffing and resourcing of the APEC Secretariat, in line with provisions taken by the Budget and Management Committee and the PSU board, respectively. We thank ABAC for its collaboration and recommendations and welcome the various activities held in 2025 to strengthen engagement with business stakeholders.36. We welcome and note the 2025 APEC Senior Officials’ Meeting (SOM) Chair’s Report, and acknowledge the work undertaken by the Steering Committee on Economic and Technical Cooperation. We endorse the Committee on Trade and Investment Annual Report to Ministers. We also note the ABAC Chair’s report. We acknowledge the contribution of PECC and the APEC Study Centers Consortium (ASCC).37. We are grateful to the Republic of Korea for its strong commitment to APEC and thank the Republic of Korea for hosting APEC 2025. We welcome preparations for APEC 2026, hosted by the People’s Republic of China and reiterate our welcome to Viet Nam, as host of APEC 2027.38. Jul, 2011., Amendment by Other Act]보건복지부 (기초노령연금과) , 044-202-3673Article 1 (Purpose)The purpose of this Act is to support the stabilization of the livelihood of low-income senior citizens and promote their welfare by providing them with basic senior pensions in consideration of the senior citizens' contribution to bringing up their descendants and advancing the country and society.Article 2 (Definitions)The definitions of terms used in this Act shall be as follows:  <Amended by Act No. 8852, Feb, 29, 2008; Act No. 9932, Jan. 18, 2010>1. The term "right to receive a senior pension" means the entitlement to receive a basic senior pension under this Act (hereinafter referred to as "pension");2. The term "qualified recipient" means a person who owns the right to receive a senior pension;3. The term "pensioner" means a person who is paid a pension under this Act;4. The term "evaluated amount of income" means the amount of income recognized under subparagraph 8 of Article 2 of the National Basic Living Security Act (limited to the evaluated amount of income of the principal and his/her spouse): Provided, That the scope of income and property that form the basis for calculation thereof, the method of calculation of the evaluated amount of income under subparagraph 9 of Article 2 of the same Act, and the method of calculation of property converted to income under subparagraph 10 of Article 2 of the same Act, may vary as prescribed by Ordinance of the Ministry of Health and Welfare.Article 3 (Objects of Pension Payments)Pensions shall be paid to persons 65 years of age or older and whose evaluated amount of income is less than the amount prescribed by Presidential Decree.Article 4 (Basic Policy for Pension Payments) (1) The State and local governments shall strive to ensure, to the maximum extent possible, that the amount of pensions payable will reach the level required to support the stabilization of the livelihood of senior citizens and promote their welfare in accordance with the purpose under Article 1.(2) The State and local governments shall secure financial resources to bear the necessary expenses under paragraph (1).(3) The State and local governments shall strive to ensure, to the maximum extent possible, that payment of pensions will not entail any income reversal between social classes, nor lower work motivation and saving incentives.  <Newly Inserted by Act No. 8557, Jul.27, 2007>Article 5 (Pension Benefits) (1) The pension benefits shall be an amount equivalent to 5/100 of the amount under Article 51 (1) 1 of the National Pension Act: where the sum total of the evaluated amount of income and the pension benefits is more than the amount prescribed by Presidential Decree under Article 3, part of the benefits payable may be reduced, as prescribed by Presidential Decree.  <Amended by Act No. 8557, July 27, 2007>(2) Notwithstanding paragraph (1), where both the principal and his/her spouse are paid pensions, 20/100 of the respective pension benefits shall be reduced.  <Amended by Act No. 8557, July 27, 2007>Article 6 (Application for Pension) (1) A person who desires to receive a pension (hereinafter referred to as "pension applicant") or his/her relatives and other related persons may apply for the pension benefits to the Minister of Health and Welfare or the head of a local government. In such cases, the Minister of Health and Welfare or the head of a local government shall determine whether to pay the pension benefits in accordance with the result of the investigation under Article 7 without delay.  <Amended by Act No.8557, Jul. 27, 2007; Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) In filing an application under paragraph (1), a pension applicant and his/her spouse shall submit a written consent to provide the following materials or information:  <Newly Inserted by Act No.8557, Jul. 27, 2007>1. Average balance of deposits and other materials or information prescribed by Presidential Decree (hereinafter referred to as "financial information") out of materials or information on financial assets and financial transactions under subparagraphs 2 and 3 of Article 2 of the Act on Real Name Financial Transactions and Confidentiality;2. Debts and other materials or information prescribed by Presidential Decree (hereinafter referred to as "credit information") out of credit information under subparagraph 1 of Article 2 of the Use and Protection of Credit Information Act;3. Premiums paid for the insurances purchased under the subparagraphs of Article 4 (1) of the Insurance Business Act, and other materials or information prescribed by Presidential Decree (hereinafter referred to as "insurance information").(3) Matters necessary for pension applicants, methods and procedures for filing an application, and payment under paragraph (1), and the methods and procedures for giving consent under paragraph (2) shall be prescribed by Presidential Decree.  <Amended by Act No. 8557, Jul. 27, 2007>Article 7 (Investigations, Inquiries, etc.) (1) The Minister of Health and Welfare or the head of a local government may require pension applicants, qualified recipients, pensioners, and their spouses and employers (hereafter in this paragraph referred to as "qualified recipients, etc.") to submit necessary documents or other materials regarding income and/or assets, etc. for the purpose of ascertaining the accrual or forfeiture of the right to receive a senior pension, and cause his/her officials to investigate documents, etc. by entering the residence and other necessary places of the qualified recipients, etc. or ask related persons necessary questions.  <Amended by Act No, 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) The Minister of Health and Welfare or the head of a local government may ask the head of a related agency to provide materials pertaining to financial information, credit information, insurance information, information on commencement of imprisonment and the release of inmates imprisoned in correctional institutions or medical treatment and detention center, national or local taxes, land, buildings, health insurance, national pension, immigration, etc., which are required to perform investigations under paragraph (1) or the basic senior pension projects. In such cases, the head of a related agency who has received such request for provision of materials shall comply with such request unless there are particular reasons to the contrary.  <Amended by Act, No. 8557, Jul. 27, 2007; Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010; Act No. 10508, Mar. 30, 2011>(3) Each person who makes entry, investigation and inquiries as prescribed in paragraph (1) shall carry a certificate indicating his/her authority and present it to persons concerned.(4) Where a qualified recipient or pensioner refuses to submit documents or materials under paragraph (1) or refuses, obstructs or evades investigations and inquiries, the Minister of Health and Welfare or the head of a local government may reject the application for the payment of a pension or cancel, stop or suspend the decision to pay a pension.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(5) Other necessary matters concerning the scope, timing and content of the investigations and inquiries under paragraph (1) shall be prescribed by Presidential Decree.  <Newly Inserted by Act No. 8557, Jul. 27, 2007>Article 7-2 (Provision of Financial Information, etc.) (1) Notwithstanding Article 4 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 32 (1) of the Use and Protection of Credit Information Act, the Minister of Health and Welfare may request the heads of financial companies, etc. (referring to financial institutions as defined in subparagraph 1 of Article 2 of the Act on Real Name Financial Transactions and Confidentiality and credit information collection agencies as defined in Article 25 of the Use and Protection of Credit Information Act: hereinafter the same shall apply) to provide financial information, credit information or insurance information (hereinafter referred to as "financial information, etc.") in accordance with electronic documents converted from the written consents submitted by pension applicants and their spouses under Article 6 (2).  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9617, Apr. 1, 2009; Act No. 9932, Jan. 18, 2010; Act No. 10854, Jul. 14, 2011>(2) Notwithstanding Article 4 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 32 (1) of the Use and Protection of Credit Information Act, the Minister of Health and Welfare, if he/she deems it necessary to review the right to receive a senior pension of a pensioner (including his/her spouse), may ask the heads of financial institutions, etc. to provide financial information, etc. by means of a document describing his/her personal information or information and communications network, in accordance with the standards prescribed by Presidential Decree.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9617, Apr. 1, 2009; Act No. 9932, Jan. 18, 2010>(3) Notwithstanding Article 4 of the Act on Real Name Financial Transactions and Confidentiality and Article 32 of the Use and Protection of Credit Information Act, the heads of financial institutions, etc. which have been requested to provide financial information, etc. under paragraphs (1) and (2), shall provide financial information, etc. of the owner.  <Amended by Act No. 9617, Apr. 1, 2009>(4) Notwithstanding Article 4-2 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 35 of the Use and Protection of Credit Information Act, the heads of financial institutions, etc. which provide financial information, etc. under paragraph (3), may not notify an owner of the provision of his/her financial information, etc.: Provided, That such notification shall be made when there is a request by the owner.  <Amended by Act No. 9617, Apr. 1, 2009>(5) A request to provide financial information, etc. and the provision thereof under paragraphs (1) through (3) shall be carried out by means of the information and communications network under Article 2 (1) 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.: Provided, That this shall not apply to unavoidable circumstances, such as damage to the information and communications network, etc.(6) Any person who is engaged in the business affairs prescribed in paragraphs (1) through (3) and any person who is delegated or entrusted with the authority under Article 21, shall neither provide nor disclose financial information, etc. obtained in the process of performing his/her duties to other persons for purposes other than those prescribed by this Act.(7) Necessary matters concerning requests to provide financial information, etc. and the provision thereof under paragraphs (1) through (3) and (5) shall be prescribed by Presidential Decree.[This Article Newly Inserted by Act No. 8557, Jul. 27, 2007]Article 8 (Period and Timing for Payment of Pensions) (1) Where a person is determined as a qualified recipient under Article 6, a pension shall regularly be paid to the person, on a monthly basis, from the month on which the date of application for the pension falls to the month on which the date of termination of the right to receive a senior pension falls.(2) Where a ground for suspension of the payment of a pension has accrued, the pension shall not be paid from the month following the month on which the date of accrual of such ground falls to the month on which the date of extinguishment of such ground falls.Article 9 (Pensions Payable) (1) Where a pensioner is deceased and there exists any accrued pension payable to the pensioner, a dependent who has shared the same livelihood with the pensioner at the time of his/her death (referring to his/her spouse, lineal descendant and his/her spouse) may claim such pension payable. In such cases, the Minister of Health and Welfare or the head of a local government shall determine, without delay, whether to pay such pension payable.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) Necessary matters concerning the procedure for and method of claiming any pensions payable, eligibility requirements for dependents, and the payment priority, etc. under paragraph (1) shall be prescribed by Presidential Decree.Article 10 (Suspension of Payment)If a pensioner in whose case his/her imprisonment without labor or heavier punishment is not completely executed or exempted, no pension is payable to him/her during the imprisonment period in correctional institutions under the Administration and Treatment of Correctional Institution Inmates Act or in medical treatment and detention centers under the Medical Treatment and Custody Act.  <Amended by Act No. 10508, Mar. 30, 2011>Article 11 (Forfeiture of Right to Receive Senior Pensions)A qualified recipient's right to receive a senior pension shall be forfeitable if he/she falls under any of the following subparagraphs:1. When he/she is deceased;2. When he/she loses nationality or moves overseas;3. When he/she fails to meet the requirements to receive benefits under Article 3.Article 12 (Recovery of Undue Gains) (1) Where a person who does not have the right to receive a senior pension has been paid pension benefits, the Minister of Health and Welfare or the head of a local government shall collect the amount paid, as prescribed by Presidential Decree.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) Where a person who is supposed to return the amount paid under paragraph (1) fails to do so, it shall be collected by referring to the practices of dispositions on default of the national or local taxes.Article 13 (Protection of Right to Receive Senior Pensions) (1) The right to receive a senior pension shall not be transferred, seized, or provided as collateral.(2) No money and valuables provided as pension benefits shall be seized.Article 14 Deleted. <by Act No. 8557, Jul. 27, 2007>Article 15 (Filing of Appeal) (1) A person who is dissatisfied with the eligibility requirements of a qualified recipient or other dispositions in accordance with this Act, may file an appeal with the Minister of Health and Welfare or the head of a local government.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) The filing of an appeal under paragraph (1) shall be made in writing within 90 days from the date on which the person concerned is aware of such disposition: Provided, That where he/she has attested that such filing could not be carried out within the aforementioned period of time on justifiable grounds, he/she may file an appeal within 60 days from the date on which such grounds are extinguished.Article 16 (Prescription)The period of prescription of the right of the State and local governments to collect undue gains and the right of a qualified recipient under Article 12 shall expire unless they are exercised for five years.Article 17 (Treatment of Fractional Amount)In calculating undue gains under this Act, any fractional amount of less than 1,000 won shall be written off.Article 18 (Reporting)Where a ground for forfeiture of the right to receive a senior pension has accrued, a pensioner shall report such to the Minister of Health and Welfare or the head of a local government, as prescribed by Ordinance of the Ministry of Health, Welfare and Family Affairs: if the pensioner is deceased, a person liable to report under Article 88 of the Family Register Act shall report his/her death to the Minister of Health and Welfare or the head of a local government, within such period as specified by Ordinance of the Ministry of Health and Welfare.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>Article 19 (Liability to Award Pensions)The liability to award pensions shall be borne by the State or local governments, as prescribed by any of the following subparagraphs:  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>1. The State shall bear the ratio prescribed by Presidential Decree within the scope of not less than 40/100 but not more than 90/100 in consideration of the ratio of the senior citizens and financial circumstances of a local government;2. The expenses less the amount borne by the State under subparagraph 1 shall be mutually assumed by the Special Metropolitan City, Metropolitan Cities, Dos or a Special Self-Governing Province (hereinafter referred to as "Cities/Dos") and Sis, Guns and Gus (referring to autonomous Gus; hereinafter the same shall apply): Provided, That the allotment ratio shall be determined by Ordinance of Cities/Dos in consideration of the ratio of the senior citizens and financial circumstances of a local government, and prior consultation shall be made with the Minister of Health and Welfare.Article 20 (Reduction and Exemption of Taxes and Other Public Dues)Taxes and other public dues for a pension paid under Article 8 shall be reduced or exempted pursuant to the Restriction of Special Taxation Act, other Acts, or Ordinance of a local government.Article 20-2 (Establishment and Operation of Information System for Basic Senior Pension)The Minister of Health and Welfare may establish and operate the basic senior pension information system to efficiently handle a variety of materials or information required to conduct basic senior pension projects in relation to Articles 6 through 12, 14, 15, 18 and 23 and process the recording and management business through the computer system, as prescribed by Presidential Decree.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>[This Article Newly Inserted by Act No. 8557, Jul. 27, 2007]Article 21 (Delegation and Entrustment of Authority) (1) Part of the authority held by the Minister of Health and Welfare under this Act may be delegated to the Special Metropolitan City Mayor, Metropolitan City Mayors, Do governors, the Governor of a Special Self-Governing Province (hereinafter referred to as "City Mayors/Do Governors") or the heads of Sis/Guns/Gus (referring to the heads of autonomous Gus; hereinafter the same shall apply), as prescribed by Presidential Decree.  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(2) The following duties of the Minister of Health and Welfare or the head of a local government may be commissioned to the National Pension Service under Article 24 of the National Pension Act, as prescribed by Presidential Decree.  <Amended by Act No.8557, Jul. 27, 2007; Act No. 8852, Feb 29, 2008; Act No. 9932, Jan. 18, 2010>1. Receipt of application for a pension under Article 6 (1);2. Support for investigations and inquiries by public officials under Article 7 (1);3. Receipt of application for an appeal filed under Article 15 (1);4. Receipt of report of a ground for forfeiture of the right to receive a senior pension under Article 18;4-2. Matters concerning establishment and operation of the basic senior pension information system under Article 20-2;5. Other matters concerning support for the management of pensioners prescribed by Presidential Decree.Article 22 (Penal Provisions) (1) Any person who provides or discloses financial information to other persons in violation of Article 7-2 (6) shall be punished by imprisonment for not more than five years or a fine not exceeding 30 million won.(2) Any person who provides or discloses credit information or financial information to other persons in violation of Article 7-2 (6) shall be punished by imprisonment for not more than three years or a fine not exceeding 20 million won.(3) Any person who is paid a pension by fraudulent or other wrongful means shall be punished by imprisonment for not more than one year or a fine not exceeding 5 million won.[This Article Wholly Amended by Act No. 8557, Jul. 27, 2007]Article 22-2 (Joint Penal Provisions)Where the representative of a corporation, or an agent, employee, or other servant of a corporation or an individual violates Article 22 (1) or (2) in connection with the business of the corporation or individual, not only shall such offender be punishable accordingly, but the corporation or individual shall also be punishable by a fine prescribed in the relevant provisions; Provided, That, this shall not apply where corporations or individuals continuously pay attention to and supervise relevant tasks in order to prevent such violation.  <Amended by Act No. 10508, Mar. 30, 2011>[This Article Newly Inserted by Act No. 8557, Jul. 27, 2007]Article 23 (Fines for Negligence) (1) Any person who fails to submit documents or other materials pertaining to his/her income and assets under Article 7, provides false materials, or refuses, obstructs or evades investigations and inquiries, or provides false answers, without any justifiable ground, shall be punished by a fine for negligence not exceeding 200,000 won.(2) Any person who fails to file a report under Article 18 without any justifiable ground shall be punished by a fine for negligence not exceeding 100,000 won.(3) Fines for negligence under paragraphs (1) and (2) shall be levied and collected by the Minister of Health and Welfare, the City Mayors/Do Governors, and the heads of Sis/Guns/Gus (hereinafter referred to as "competent authorities"), as prescribed by Presidential Decree  <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>(4) Any person who is dissatisfied with the disposition of a fine for negligence under paragraph (3) may raise an objection to the competent authorities within 30 days from the date on which he/she received a notice of such disposition.(5) If a person who is subject to the disposition of a fine for negligence under paragraph (3) raises an objection as described in paragraph (4), the competent authorities shall, without delay, notify the competent court thereof, and the court in receipt of such notice shall submit the case to a trial for a fine for negligence pursuant to the Non-Contentious Case Litigation Procedure Act.(6) If no objection is raised within the period under paragraph (4) nor a fine for negligence paid, such fine for negligence shall be collected by referring to the practices of dispositions on default of national or local taxes.부칙  ADDENDA<Act No. 9932,  Jan. 18,  2010>Article 1 (Enforcement Date) This Act shall enter into force two months after the date of its promulgation. Jun, 2021., Partial Amendment]보건복지부 (기초연금과) , 044-202-3678CHAPTER I GENERAL PROVISIONSArticle 1 (Purpose) The purpose of this Act is to support stabilization of the living of senior citizens and to promote their welfare by providing a stable income base through payment of a basic pension.Article 2 (Definitions) The terms used in this Act are defined as follows:1. The term "entitlement to a basic pension" means the right to receive a basic pension under this Act;2. The term "eligible recipient of a basic pension" means a person entitled to a basic pension;3. The term "recipient of a basic pension" means a person to whom a basic pension is paid under this Act;4. The term "assessed income" means the total assessed amount of income of the principal and his or her spouse and the income-equivalent of their property. In this regard, the scope of income and property for calculation of the assessed amount of income and the income-equivalent of property shall be prescribed by Presidential Decree, and the detailed methods for calculating assessed amount of income and the income-equivalent of property shall be prescribed by Ordinance of the Ministry of Health and Welfare.Article 3 (Scope of Eligible Recipients of Basic Pensions) (1) Basic pensions shall be paid to persons of at least 65 years of age whose assessed income is at or below the amount determined and publicly notified by the Minister of Health and Welfare (hereinafter referred to as "income threshold").(2) In determining the income threshold, the Minister of Health and Welfare shall ensure that the number of recipients of basic pensions accounts for 70/100 of the total number of persons who are at least 65 years of age.(3) Notwithstanding paragraph (1), no pension shall be paid to a recipient of any of the following pensions and his or her spouse and to a person prescribed by Presidential Decree, among persons who have received any of the following pensions and their spouses:  <Amended on Mar. 20, 2018; Dec. 10, 2019>1. Retirement pension, lump-sum retirement pension, lump-sum retirement pension after deductions, disability pension, disability pension for reasons other than official duties, non-service disability pension, lump-sum payment for disability, lump-sum disability payment for reasons other than official duties, lump-sum payment for non-service disability, retirement pension for survivors, disability pension for survivors, survivors' pension for a public official who died in the line of duty, survivors’ pension for a person who died while doing his or her job, survivors' pension for a public official who died in the line of dangerous duty, lump-sum retirement pension for survivors, or lump-sum payment on retirement for survivors prescribed in Article 28 of the Public Officials Pension Act, Article 8 of the Public Officials' Accident Compensation Act, or Article 42 (1) of the Pension for Private School Teachers and Staff Act [in cases of lump-sum payment on retirement for survivors, limited to where a recipient of survivors' pension for a public official who died in the line of duty chooses it in lieu of such pension pursuant to Article 20 (1) of the Public Officials' Accident Compensation Act (including where a recipient of survivors' pension for a person who died while doing his or her job chooses it in lieu of such pension prescribed in Article 42 (1) of the Pension for Private School Teachers and Staff Act) and where a recipient of survivors' pension for a public official who died in the line of dangerous duty chooses it in lieu of such pension pursuant to Article 20 (2) of the same Act];2.Retirement pension, retirement pension in one lump sum, retirement pension in one lump sum after deduction, survivor’s pension or survivor’s lump-sum pension under Article 7 of the Military Pension Act, or pension for wounds, survivor's pension, or survivor's pension in one lump sum prescribed in Article 7 of the Military Accident Compensation Act;3. Retirement pension, lump sum pension at retirement, lump sum retirement pension deduction, pension for the bereaved family, or lump sum bereaved family's pension prescribed in Article 24 (2) of the Special Post Offices Act;4. Aggregate retirement pension or aggregate retirement pension for bereaved family members where the period of occupational employment defined in Article 2 (1) 7 of the Act on Aggregation of National Pension and Occupational Pensions is at least 10 years among aggregate retirement pension and aggregate retirement pension for bereaved family members prescribed in Articles 10 and 13 of the same Act.(4) Standards for determining the income threshold, timing for public notice, a period for application, etc. shall be prescribed by Presidential Decree.Article 4 (Responsibility of the State and Local Governments) (1) The State and local governments shall endeavor to ensure, to the maximum extent possible, that the amount of basic pensions payable reaches the level required to support the stabilization of the livelihood of senior citizens and promote their welfare in accordance with the purpose under Article 1.(2) The State and local governments shall secure financial resources to bear the necessary expenses under paragraph (1). In this regard, no National Pension Fund established under Article 101 (1) of the National Pension Act shall be used as a financial resource for payment of basic pensions.(3) The State and local governments shall strive to the maximum extent possible to ensure that the payment of basic pensions does not entail any income reversal between social classes, nor lower motivation to work and incentives to pay.CHAPTER II CALCULATION OF BASIC PENSION BENEFITSArticle 5 (Calculation of Basic Pension Benefits) (1) The amount of basic pensions for an eligible recipient of a basic pension (hereinafter referred to as "basic pension benefits") shall be calculated based upon the standard pension benefits prescribed in paragraph (2) or Article 5-2 (1) (hereinafter referred to as "standard pension benefits"), national pension benefits, etc.  <Amended on Jan. 15, 2019>(2) Standard pension benefits shall be publicly notified each year by the Minister of Health and Welfare, based on the Fluctuation Rate of Nation-wide Consumer Price Index (referring to the fluctuation rate of nation-wide consumer price index publicly notified by the Commissioner of the Korea National Statistical Office each year under Article 3 of the Statistics Act; hereafter the same shall apply in this Article). In such cases, the applicable period for standard pension benefits publicly notified shall be from January to December of the relevant year of adjustment.  <Amended on Jan. 15, 2019; Jan. 21, 2020>(3) Notwithstanding the former part of paragraph (2), the standard pension benefits for 2021 shall be 300,000 won.  <Newly Inserted on Mar. 27, 2018; Jan. 21, 2020>(4) Basic pension benefits payable to any of the following persons entitled to receive the following pensions (hereinafter referred to as "recipient of national pension") among eligible recipients of basic pensions shall be the amount calculated under paragraph (5):  <Amended on Mar. 27, 2018>1. Eligible recipients of an old-age pension or dividend pension prescribed in Article 61 or 64, or Article 2, 6 or 9 of the Addenda to the wholly amended National Pension Act (Act No. 8541);2. Eligible recipients of a national pension prescribed in Article 26-2 of the North Korean Refugees Protection and Settlement Support Act.(5) Basic pension benefits payable to eligible recipients of a national pension shall be the amount obtained by deducting the amount prescribed in subparagraph 2 from the amount prescribed in subparagraph 1 (where the remainder after the deduction is less than zero, it shall be written off) and adding the amount prescribed in subparagraph 3:  <Amended on Mar. 27, 2018; Jan. 15, 2019>1. Standard pension benefits (in cases of the recipients of basic pensions to whom Article 5-2 is applied, referring to the amount of standard pension benefits prescribed in Article 5-2; hereinafter the same shall apply);2. An amount obtained by multiplying the amount calculated on the basis of the amount prescribed in Article 51 (1) 1 of the National Pension Act (referring to the amount adjusted each year under Article 51 (2) of the National Pension Act; hereinafter referred to as "amount of benefits reflecting redistribution of income") by 2/3, among pension benefits payable to an eligible recipient of a national pension: Provided, That the standard amount of pensions, which becomes the base for calculation of the amount of benefits reflecting redistribution of income for such cases as delayed or early payment, additional or reduced payment, etc. of the pension benefits of eligible recipients of a national pension under the National Pension Act, shall be prescribed by Presidential Decree;3. Additional pension benefits: An amount equivalent to 1/2 of the standard pension benefits.(6) Eligible recipients of aggregated old-age pension prescribed in Article 10 of the Act on Aggregation of National Pension and Occupational Pensions among eligible recipients of basic pensions shall be paid an amount obtained by deducting the amount prescribed in subparagraph 2 from the amount prescribed in subparagraph 1 (where the remainder after the deduction is less than zero, it shall be deemed written off) and adding the amount prescribed in subparagraph 3:  <Amended on Mar. 27, 2018>1. Standard pension benefits;2. An amount obtained by multiplying the total of amounts prescribed in items (a) and (b) by 2/3:(a) Amount of benefits reflecting redistribution of income;(b) An amount obtained by multiplying the amount of aggregated retirement pension prescribed in Article 12 of the Act on Aggregation of National Pension and Occupational Pensions by 1/2;3. Additional pension benefits: An amount equivalent to a half of the standard pension benefits.(7) Basic pension benefits payable to any of the following persons qualified for basic pensions shall be the standard pension benefits:  <Amended on Mar. 27, 2018>1. A person not falling under any subparagraph of paragraph (4), or paragraph (6);2. Any of the following persons falling under any subparagraph of paragraph (4), or paragraph (6):(a) An old-age pension or dividend pension recipient for whom payment of a national pension is suspended under Article 56 (1) of the National Pension Act;(b) A recipient prescribed in Article 4 of the Act on Pensions for Persons with Disabilities;(c) An eligible recipient defined in Article 2 of the National Basic Living Security Act, prescribed by Presidential Decree;(d) Other persons prescribed by Presidential Decree.Article 5-2 (Special Cases on Calculation of Basic Pension Benefits for Low-Income Recipients Eligible for Basic Pensions) (1) Notwithstanding the former part of Article 5 (2), the basic pension benefits applied to the persons aged 65 or older, whose assessed income does not exceed 40/100, shall be 300,000 won.  <Amended on Jan. 21, 2020>(2) The Minister of Health and Welfare shall determine and publicly notify the assessed income for selecting a person eligible for the basic pension benefits prescribed in paragraph (1) (hereinafter referred to as “income threshold for identifying low-income individuals”).(3) The standards for determining the income threshold for identifying low-income individuals, the timing for public notice, the period for application, etc. shall be prescribed by Presidential Decree.[Moved from Article 12  <Jan. 15, 2019>][This Article shall remain effective until December 31, 2022 pursuant to Article 2 of the Addenda (Act No. 17858, Jan. 5, 2021)]Article 6 (Special Cases on Calculation of Basic Pension Benefits Based on National Pension Benefits) (1) Notwithstanding Article 5, basic pension benefits payable to a person whose benefits entitlement each month owing to the entitlement thereto prescribed in the National Pension Act and the Act on Aggregation of National Pension and Occupational Pensions (excluding amount of dependant pension prescribed in Article 52 of the National Pension Act; hereinafter referred to as "national pension benefits, etc.") does not exceed 150/100 of the standard pension benefits, among persons falling under any subparagraph of Article 5 (4) or Article 5 (6), shall be the standard pension benefits.  <Amended on Mar. 27, 2018>(2) Notwithstanding Article 5, basic pension benefits payable to a person in whose case the national pension benefits, etc. exceed 150/100 but not more than 200/100 among persons falling under any subparagraph of Article 5 (4) or Article 5 (6) may be determined in at least the amount calculated under Article 5 within the limit of standard pension benefits, as prescribed by Presidential Decree.  <Amended on Mar. 27, 2018>Article 7 (Limits on Basic Pension Benefits) Where basic pension benefits calculated under Article 5 (4) through (6) exceed standard pension benefits, standard pension benefits shall be deemed the basic pension benefits.  <Amended on Mar. 27, 2018>Article 8 (Reduction of Basic Pension Benefits) (1) Where both the principal and his or her spouse are eligible recipients of basic pensions, an amount equivalent to 20/100 of the basic pension benefits shall be deducted from their respective basic pension benefits.(2) Where the assessed income and basic pension benefits prescribed in Articles 5, 5-2, 6 and 7 (where paragraph (1) is applied, referring to the amount reflecting the reduced amount) are at least the income threshold, part of basic pension benefits may be reduced within an amount exceeding the income threshold.  <Amended on Jan. 15, 2019>(3) Where the sum of the assessed income of an eligible recipient of a basic pension to whom Article 5-2 is applied and the relevant basic pension benefits (where Article 8 (1) is applied, referring to the amount reflecting the reduced amount) is at least the sum of the income threshold for identifying low-income individuals and the standard pension benefits (referring to the standard pension benefits of an eligible recipient of a basic pension who does not fall under Article 5-2), the basic pension benefits of the eligible recipient of the basic pension to whom Article 5-2 is applied may be partially reduced.  <Newly Inserted on Jan. 15, 2019>(4) Detailed standards for reduction prescribed in paragraphs (2) and (3) shall be prescribed by Presidential Decree.  <Amended on Jan. 15, 2019>Article 9 (Evaluation of Appropriateness of Basic Pension Benefits) (1) Notwithstanding the provisions of Article 5 (2), the Minister of Health and Welfare shall evaluate the appropriateness of basic pension benefits taking into comprehensive consideration the living standards of eligible recipients of basic pensions, the rate of change of the amount prescribed in Article 51 (1) 1 of the National Pension Act, the fluctuation rate of nation-wide consumer price index, etc., and shall adjust standard pension benefits reflecting the outcomes thereof.(2) When an evaluation of appropriateness is conducted under paragraph (1), the survey on actual condition of the poverty of senior citizens and the prospect of long-term financial requirements of basic pensions shall be conducted together.(3) The Minister of Health and Welfare shall publicly notify the standard pension benefits adjusted under paragraph (1). In such cases, such public notice shall be deemed a public notice made under the forepart of Article 5 (2).(4) Matters necessary for the adjustment of standard pension benefits under paragraph (1), the prospect of long-term financial requirements and the survey on actual condition of the poverty of senior citizens under paragraph (2), public notice of standard pension benefits under paragraph (3), etc. shall be prescribed by Presidential Decree.CHAPTER III APPLICATION FOR AND DECISION ON PAYMENT OF BASIC PENSIONSArticle 10 (Application for Payment of Basic Pensions) (1) A person who intends to receive a basic pension (hereinafter referred to as "basic pension applicant") or his or her representative prescribed by Ordinance of the Ministry of Health and Welfare may file an application for the payment of a basic pension with a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (Gu refers to an autonomous Gu; hereinafter the same shall apply).(2) When a basic pension applicant and his or her spouse file an application under paragraph (1), they shall submit a document indicating their consent to the provision of the following data or information to the Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (including persons entrusted with the duties under Article 28 (2)):1. Average balance of deposits among data or information regarding the details of financial assets and financial transactions under subparagraphs 2 and 3 of Article 2 of the Act on Real Name Financial Transactions and Confidentiality and other data or information prescribed by Presidential Decree (hereinafter referred to as “financial information”);2. Amount of debts among credit information under subparagraph 1 of Article 2 of the Credit Information Use and Protection Act, and other data or information prescribed by Presidential Decree (hereinafter referred to as “credit information”);3. Premiums paid after purchasing insurance under the subparagraphs of Article 4 (1) of the Insurance Business Act and other data or information prescribed by Presidential Decree (hereinafter referred to as "insurance information").(3) A corporation, organization, facility, institution, etc. designated by a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may assist a basic pension applicant in filing an application for the payment of a basic pension under paragraph (1), at the request of such applicant.  <Newly Inserted on Jun. 8, 2021>(4) Matters necessary for the methods and procedures for filing an application for the payment of a basic pension under paragraph (1) and the methods and procedures for obtaining consent under paragraph (2), etc. shall be prescribed by Presidential Decree.  <Amended on Jun. 8, 2021>Article 10-2 (Provision of Information on Basic Pension) (1) The Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall provide persons aged 65 or older with information on basic pension including eligibility requirements, amount, and application method.(2) Such matters as detailed information to be provided, methods and procedures therefor under paragraph (1) shall be determined by Presidential Decree.[This Article Newly Inserted on Feb. 3, 2016]Article 11 (Investigations and Inquiries) (1) The Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may request a basic pension applicant, an eligible recipient of a basic pension, a recipient of a basic pension and the relevant spouse and employer (hereafter in this paragraph referred to as "eligible recipient of a basic pension, etc.") to submit necessary documents or other data related to income, assets, etc. for the purpose of ascertaining the accrual, change, loss, etc. of his or her right to receive a basic pension, and may order public officials under his or her jurisdiction to visit the residence of the eligible recipient of a basic pension, etc. or other places and examine relevant documents or ask interested persons questions.  <Amended on Feb. 3, 2016>(2) The Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may request the head of a relevant institution to provide the following data or information for the purpose of ascertainment or investigation conducted under paragraph (1) or providing basic pension services. Upon receipt of such request, the head of the institution shall comply therewith, except in extenuating circumstances:  <Amended on Dec. 27, 2016; Mar. 20, 2018; Aug. 27, 2019>1. Data or information related to income and property:(a) Financial information, credit information and insurance information;(b) Taxation information prescribed in Article 81-13 of the Framework Act on National Taxes and Article 86 of the Framework Act on Local Taxes, for which the consent of a person directly involved is obtained;(c) Data or information related to land, buildings, automobiles, vessels, aircraft, right of residence in a housing unit, ownership of parceled-out housing unit, standing trees, fishing rights, aquaculture rights and membership rights defined in subparagraphs 14 through 18 of Article 6 of the Local Tax Act;(d) Data or information related to the receipt of a national pension, health insurance, employment insurance, industrial accident compensation insurance, veterans' benefits, public officials' pension, public officials' accident compensation benefits, military pension, pension for teachers at private schools, and special post office pension;2. Data or information related to personal information:(a) Data or information related to entry into or departure from the country;(b) Data or information related to the commencement of imprisonment in or discharge from correctional institutions prescribed in the Administration and Treatment of Correctional Institution Inmates Act (hereinafter referred to as "correctional institutions") and medical treatment and detention facilities prescribed in the Medical Treatment and Custody Act (hereinafter referred to as "medical treatment and detention facilities");(c) Data or information on criminal records;(d) Data or information related to burial, cremation, and funeral;(e) Data or information on resident registration and family registration;(f) Data or information on reports on runaways or missing persons and management of an absentee's property.(3) The relevant public official who visits a residence, etc. and conducts investigation and inquiries as prescribed in paragraph (1) shall carry a certificate indicating his or her authority and documents specifying the duration of investigation, scope of investigation, investigator-in-charge, applicable statutes, and other matters determined by Ordinance of the Ministry of Health and Welfare and show them to interested persons.  <Amended on Feb. 3, 2016>(4) Where a basic pension applicant, eligible recipient of a basic pension, or recipient of a basic pension fails to submit documents or data prescribed in paragraph (1), submits a false document or data, or refuses, interferes with or evades investigation or inquiries, or makes a false reply, the Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may reject the application for the payment of a basic pension, or cancel or suspend payment of a basic pension.(5) In receiving data or information prescribed in paragraph (2), charges, fees, etc. to be imposed under the relevant statutes shall be exempted.(6) Except as provided in this Act, the scope, timing, details, procedures and methods of the investigations and inquiries prescribed in paragraph (1) shall be governed by the Framework Act on Administrative Investigations and other necessary matters shall be determined by Presidential Decree.  <Amended on Feb. 3, 2016>Article 12 (Provision of Financial Information) (1) Notwithstanding the provisions of Article 4 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 32 (1) of the Credit Information Use and Protection Act, the Minister of Health and Welfare, where he or she deems it necessary for providing basic pension services and examining the entitlement to a basic pension of a basic pension applicant (including his or her spouse), may request the heads of financial institutions, etc. (referring to financial companies, etc. defined in subparagraph 1 of Article 2 of the Act on Real Name Financial Transactions and Confidentiality and credit information collection agencies under Article 25 of the Credit Information Use and Protection Act; hereinafter the same shall apply) to provide financial information, credit information, or insurance information (hereinafter referred to as "financial information, etc.") of the basic pension applicant and his or her spouse on the ground of a written consent submitted by the basic pension applicant and his or her spouse under Article 10 (2) which is converted into electronic form.(2) Notwithstanding the provisions of Article 4 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 32 (1) of the Credit Information Use and Protection Act, the Minister of Health and Welfare may, where he or she deems it necessary for examining the entitlement of a basic pension applicant to receive a basic pension, request the heads of financial institutions, etc. by a document in which personal information is stated in accordance with the standards prescribed by Presidential Decree or through information and communications networks to provide financial information, etc. of the eligible recipient of a basic pension and his or her spouse.(3) Notwithstanding the provisions of Article 4 of the Act on Real Name Financial Transactions and Confidentiality and Article 32 of the Credit Information Use and Protection Act, the head of a financial institution, etc. in receipt of a request for provision of financial information, etc. under paragraphs (1) and (2) shall provide financial information, etc. of the relevant titleholder.(4) Notwithstanding the provisions of Article 4-2 (1) of the Act on Real Name Financial Transactions and Confidentiality and Article 32 (7) of the Credit Information Use and Protection Act, the head of a financial institution, etc. which provides financial information, etc. under paragraph (3) may not notify its titleholder of the provision of his or her financial information, etc.: Provided, That such notification shall be made when requested by the titleholder of the financial information, etc.  <Amended on Mar. 11, 2015>(5) A request to provide financial information, etc. and provision of such financial information, etc. under paragraphs (1) through (3) shall be made via an information and communications network defined in Article 2 (1) 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection: Provided, That this shall not apply to inevitable cases, such as breakdown of an information and communications network.(6) No person engaged in the business affairs prescribed in paragraphs (1) through (3) (including persons delegated or entrusted with the authority under Article 28) shall provide nor disclose financial information, etc. obtained in the course of performing his or her duties to other persons for purposes other than those prescribed by this Act.(7) Matters necessary for requests to provide financial information, etc. and the provision thereof, etc. under paragraphs (1) through (3) and (5) shall be prescribed by Presidential Decree.Article 13 (Determination on Payment of Basic Pensions) (1) A Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall determine the accrual, change, loss, etc. of entitlement to a basic pension after conducting an investigation under Article 11.(2) In determining the accrual of entitlement to a basic pension, where the income and property level of a basic pension applicant and his or her spouse appraised through all or some of the data and information provided pursuant to Article 11 or 12 is equivalent to or lower than the level prescribed by the Minister of Health and Welfare, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may omit part of the relevant investigation and determine the accrual of entitlement to a basic pension.  <Newly Inserted on Jun. 8, 2021>(3) Where a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu makes a determination under paragraph (1), he or she shall notify the eligible recipient of a basic pension of the details of such determination in writing without delay, specifying grounds therefor.  <Amended on Jun. 8, 2021>(4) Matters necessary for the procedures for determining the accrual, change, loss, etc. of entitlement to a basic pension and the notification, etc. thereof under paragraphs (1) and (3) shall be prescribed by Presidential Decree.  <Amended on Jun. 8, 2021>Article 14 (Payment of and Timing for Paying Basic Pensions) (1) A Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall regularly pay a basic pension to a person determined as an eligible recipient of a basic pension pursuant to Article 13 (1), on a monthly basis, from the month in which the date of an application for payment of a basic pension falls to the month in which the date of loss of entitlement to a basic pension falls pursuant to Article 17.(2) No basic pension shall be paid for a period during which the payment of a basic pension is suspended under Article 16 (1).(3) Matters necessary for the methods, procedures, etc. for payment of a basic pension under paragraphs (1) and (2) shall be prescribed by Ordinance of the Ministry of Health and Welfare.CHAPTER IV EX POST MANAGEMENT OF RECIPIENTS OF BASIC PENSIONSArticle 15 (Basic Pensions Payable) (1) Where a recipient of a basic pension is deceased and any accrued pension is payable to him or her, a person who is obliged to support the recipient of a basic pension (referring to his or her spouse, lineal descendant and his or her spouse) and has shared the same livelihood with him or her as at the time of his or her death may claim such pension payable. In such cases, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall determine without delay whether to pay it and notify the results thereof to the person obliged to support him or her.(2) Matters necessary for the procedures for and methods of claiming any pensions payable, requirements for eligibility of a person obliged to provide support, payment priority, etc. under paragraph (1) shall be prescribed by Presidential Decree.Article 16 (Suspension of Payment of Basic Pensions) (1) Where a recipient of a basic pension falls under any of the following cases, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall suspend the payment of his or her basic pension from the month following that in which such ground arose until the month the ground extinguished:1. Where a recipient of a basic pension is confined in a correctional institution or a medical treatment and detention facility after a declaration of imprisonment without labor or greater punishment by a court;2. Where a recipient of a basic pension is presumed to be deceased, such as in cases of unknown whereabouts or disappearance;3. Where the length of overseas stay of a recipient of a basic pension continues for at least 60 days. In such cases, the date on which the 60th day of overseas stay falls shall be deemed the date the ground for suspension of payment occurs;4. Other cases prescribed by Presidential Decree, which correspond to those prescribed in subparagraphs 1 through 3.(2) Matters necessary for the procedures, etc. for suspension of payment under paragraph (1) shall be prescribed by Ordinance of the Ministry of Health and Welfare.Article 17 (Loss of Entitlement to Basic Pensions) A recipient of a basic pension shall lose his or her entitlement to a basic pension in any of the following cases:1. When an annuitant dies;2. When he or she loses nationality or emigrates overseas;3. When he or she ceases to be an eligible recipient of a basic pension under Article 3.Article 18 (Reporting on Transfer of Residence) (1) In any of the following cases, a recipient of a basic pension shall file a report thereon with a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu within 30 days, as prescribed by Presidential Decree: Provided, That in cases falling under subparagraph 2 (limited to cases falling under subparagraph 1 of Article 17), a person obliged to report under Article 85 of the Act on the Registration of Family Relationships shall file a report with a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu:1. Where a ground for suspension of payment under Article 16 (1) extinguishes;2. Where a ground for loss of entitlement to a basic pension arises, as prescribed in Article 17;3. Where any change occurs in the income or property of the recipient of a basic pension or his or her spouse that falls under the standards prescribed by Presidential Decree;4. Where the recipient of a basic pension gets married or divorced or his or her spouse dies;5. Where any other case prescribed by Ordinance of the Ministry of Health and Welfare occurs.(2) Where a person with a reporting obligation under Article 85 of the Act on Registration of Family Relationships files a report on the death of a basic pension recipient under Article 84 of the same Act, it shall be deemed that a report under the proviso of paragraph (1) has been filed.  <Newly Inserted on Feb. 3, 2016>(3) Such matters as the information to be included in a report, methods and procedures for filing a report, etc. under paragraph (1) shall be prescribed by Ordinance of the Ministry of Health and Welfare.  <Amended on Feb. 3, 2016>Article 19 (Recovery of Basic Pensions) (1) Where a person who has received a basic pension falls under any of the following cases, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall recoup the paid basic pension benefits, as prescribed by Presidential Decree. In such cases, if he or she falls under subparagraph 1, interest shall be collected in addition to the paid basic pension benefits:1. Where the basic pension is received by fraud or other improper means;2. Where a basic pension is paid for the period of suspension of a basic pension prescribed in Article 16;3. Where a basic pension is wrongfully paid due to any other reason.(2) Where any basic pension benefits are payable to a person subject to recoupment of the basic pension benefits to be recovered under paragraph (1) (hereinafter referred to as "amount recoupable"), a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may offset the basic pension benefits payable with the amount recoupable.(3) Where the amount recoupable is less than the amount prescribed by Presidential Decree, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may choose not to recoup it.Article 20 (Notice of, Demand for, and Collection of Amount Recoupable) (1) In order to collect the amount recoupable under Article 19 (1), a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall give written notice of the payment by fixing a deadline, in which the amount to be recouped, a deadline for payment thereof, etc. are specified.(2) Where a person given notice under paragraph (1) fails to pay the amount recoupable until the relevant deadline, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall make a demand, fixing a deadline, as prescribed by Presidential Decree.(3) Where a person who is demanded under paragraph (2) fails to pay the amount recoupable until the relevant deadline, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall collect it pursuant to precedents of dispositions of default on local taxes.CHAPTER V PROTECTION OF RIGHTS OF ELIGIBLE RECIPIENTS OF BASIC PENSIONSArticle 21 (Protection of Entitlement to Basic Pensions) (1) No entitlement to a basic pension shall be transferred or provided as collateral, nor become subject to seizure.(2) No money or valuables provided as basic pension benefits shall be seized.Article 22 (Filing of Appeals) (1) A person dissatisfied with any determination made under Article 13 or other dispositions imposed under this Act may file an appeal with a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu.(2) The filing of an appeal under paragraph (1) shall be conducted in writing within 90 days from the date on which the relevant person becomes aware of such disposition: Provided, That where he or she has attested that such filing could not be carried out within the aforementioned period due to any justifiable ground, he or she may file an appeal within 60 days from the date on which such grounds are extinguished.(3) Matters necessary for the procedures for filing an appeal, notification of a determination on the results thereof, etc. under paragraphs (1) and (2) shall be prescribed by Ordinance of the Ministry of Health and Welfare.CHAPTER Ⅵ SUPPLEMENTARY PROVISIONSArticle 23 (Prescription) If the right of an eligible recipient of a basic pension under Article 19 is not exercised within five years, the extinctive prescription shall be completed.Article 24 (Treatment of Fraction) In calculating basic pension benefits, amount recoupable, etc. under this Act, any fraction of less than 10 won shall be written off.Article 25 (Apportionment of Expenses) (1) The State shall apportion the expense prescribed by Presidential Decree in the range from 40/100 to 90/100 of the expenses incurred in relation to the payment of a basic pension, taking into consideration the demographic ratio of senior citizens, financial condition, etc. of local governments.(2) Any remainder after deducting the expense to be borne by the State under paragraph (1) shall be mutually shared among the Special Metropolitan City, a Metropolitan City, a Special Self-Governing City, a Special Self-Governing Province (hereinafter referred to as "City/Do") and a Si/Gun/Gu (referring to an autonomous Gu; hereinafter the same shall apply). Feb, 2024., Amendment by Other Act]보건복지부 (기초연금과) , 044-202-3678Article 1 (Purpose) The purpose of this Decree is to prescribe matters mandated by the Basic Pension Act and matters necessary to enforce said Act.Article 2 (Scope of Incomes) (1) The scope of income based on which the assessed amount of income is calculated pursuant to the latter part of subparagraph 4 of Article 2 of the Basic Pension Act (hereinafter referred to as the "Act") shall be as follows:  <Amended on Nov. 30, 2015; Jun. 21, 2016; Aug. 28, 2018; Jun. 9, 2020; Jul. 26, 2022>1. Wage and salary income: Wage and salary income prescribed in Article 20 (1) of the Income Tax Act: Provided, That excluded herefrom shall be wage and salary income non-taxable prescribed in subparagraph 3 of Article 12 of the Income Tax Act, but the following pay shall be included in the wage and salary income:(a) An allowance which is non-taxable under subparagraph 3 (q) of Article 12 of the Income Tax Act;(b) A remuneration which is non-taxable under Article 16 (1) 1 of the Enforcement Decree of the Income Tax Act;2. Business income: Business income prescribed in Article 19 of the Income Tax Act;3. Property income:(a) Interest income: Income of which is at least the amount determined and publicly notified by the Minister of Health and Welfare among interest and dividend or discounted value accrued from the financial assets that fall under Article 14 (1) 1 (a) through (e);(b) Pension income: Pensions and incomes prescribed in Article 20-3 (1) 2 and 3 of the Income Tax Act and incomes accrued from pension insurance referred to in Article 4 (1) 1 (b) of the Insurance Business Act;4. Public transfer income: Various allowances, pensions, benefits, or any other money and valuables periodically offered under the National Pension Act; the Public Officials Pension Act; the Public Officials' Accident Compensation Act; the Military Pension Act; the Military Accident Compensation Act; the Special Post Offices Act; the Pension for Private School Teachers and Staff Act; the Industrial Accident Compensation Insurance Act; the Act on Aggregation of National Pension and Occupational Pensions; the North Korean Defector Protection and Settlement Support Act; the Act on the Honorable Treatment of Persons of Distinguished Service to Independence; the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State; the Act on Support for Persons Eligible for Veteran’s Compensation; the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants and Establishment of Related Organizations; the Act on Honorable Treatment of War Veterans and Establishment of Related Associations, and any other statutes or regulations determined and publicly notified by the Minister of Health and Welfare: Provided, That the following compensations and allowances shall be excluded herefrom:(a) The following compensations:(i) Compensations prescribed in Article 12 of the Act on the Honorable Treatment of Persons of Distinguished Service to Independence, within the limit of the standard amount excluded in computing the assessed amount of income (referring to the amount determined and publicly notified by the Minister of Health and Welfare at a level equivalent to the allowances for military merit honor prescribed in Article 16-2 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State; hereafter in this Article the same shall apply);(ii) Compensations within the limit of the standard amount excluded in computing the assessed amount of income, out of the compensations prescribed in Article 12 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;(iii) Compensations within the limit of the standard amount excluded in computing the assessed amount of income, out of the compensations prescribed in Article 11 of the Act on Support for Persons Eligible for Veteran’s Compensation;(b) The following allowances:(i) Cost-of-living adjustment allowances prescribed in Article 14 of the Act on the Honorable Treatment of Persons of Distinguished Service to Independence, Article 14 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State, and Article 13 of the Act on Support for Persons Eligible for Veteran’s Compensation;(ii) Nursing allowances prescribed in Article 15 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State and Article 17 of the Act on Support for Persons Eligible for Veteran’s Compensation;(iii) Allowances for military merit honor prescribed in Article 16-2 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;(iv) Allowances that are within the limit of the standard amount excluded in computing the assessed amount of income, out of the allowances for children of soldiers and police officers killed in the Korean War prescribed in Article 16-3 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;(v) Allowances for contribution to the April 19 Revolution prescribed in Article 16-4 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;(vi) Allowances prescribed in Article 7-3 of the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants and Establishment of Related Organizations;(vii) Wartime veterans pension prescribed in Article 6 of the Act on Honorable Treatment of War Veterans and Establishment of Related Associations;(c) Deleted.  <Jul. 26, 2022>(2) Where the principal or his or her spouse resides in a house owned by a lineal descendant within the first degree (limited to where the price of the house is at least the amount determined and publicly notified by the Minister of Health and Welfare), the amount calculated according to the method prescribed by Ordinance of the Ministry of Health and Welfare shall be deemed income and included in the scope of the income prescribed in paragraph (1).Article 3 (Scope of Property) (1) The scope of property for assessing amount of the income-equivalent of property prescribed in the latter part of subparagraph 4 of Article 2 of the Act shall be as follows:1. General property:(a) Standing timber defined in subparagraph 11 of Article 6 of the Local Tax Act;(b) Fishing rights defined in subparagraph 13 of Article 6 of the Local Tax Act;(c) Memberships defined in subparagraphs 14 through 18 of Article 6 of the Local Tax Act;(d) Occupation right of an association member prescribed in Article 89 (2) of the Income Tax Act;(e) Land, buildings, and housing defined in subparagraphs 1 through 3 of Article 104 of the Local Tax Act: Provided, That property owned by a clan; property jointly owned by a community; and other similar property used for common purposes shall be excluded herefrom;(f) Deposits for leasing houses, stores, buildings, etc. (including deposits for lease on a deposit basis);(g) The right to acquire a building and appertinent land when the construction of the building is completed (excluding the occupation right of an association member referred to in item (d));(h) Aircraft and ships defined in subparagraphs 4 and 5 of Article 104 of the Local Tax Act;(i) Automobiles defined in Article 124 of the Local Tax Act: Provided, That automobiles owned by persons, etc. of distinguished services to the State rated on disability under the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State, automobiles owned by persons with disabilities registered under the Act on Welfare of Persons with Disabilities, and automobiles that fulfill the criteria determined and publicly notified by the Minister of Health and Welfare among automobiles nontaxable under Article 4 (1) of the Restriction of Special Local Taxation Act shall be excluded herefrom;2. Financial assets:(a) Financial assets defined in subparagraph 2 of Article 2 of the Act on Real Name Financial Transactions and Confidentiality;(b) Insurance products defined in subparagraph 1 of Article 2 of the Insurance Business Act;3. Among assets falling under subparagraphs 1 and 2, property that has been donated to a third party or disposed of as of July 1, 2011 (excluding where it is proven that the amount of money acquired by disposal of property has been spent for the principal or his or her spouse, such as the purchase of any other property, redemption of debts, and payment of medical expenses).(2) Methods of calculating property value defined in paragraph (1) shall be prescribed by Ordinance of the Ministry of Health and Welfare.Article 4 (Criteria for Income Threshold) (1) The amount determined and publicly notified by the Minister of Health and Welfare pursuant to Article 3 (1) of the Act (hereinafter referred to as "income threshold") and the amount determined and publicly notified by the Minister of Health and Welfare pursuant to Article 5-2 (2) of the Act (hereinafter referred to as "income threshold for identifying low-income individuals") shall be calculated, based on the level of income and property as well as actual life conditions of a person of at least 65 years of age and his or her spouse (hereafter in this Article, referred to as "senior citizen household").  <Amended on Mar. 26, 2019>(2) The income threshold for a senior citizen household residing with a spouse and income threshold for low-income individuals shall be calculated by multiplying the income threshold for a senior citizen household living without a spouse and income threshold for identifying low-income individuals by 160/100.  <Amended on Mar. 26, 2019>(3) Notwithstanding paragraph (2), the income threshold for a senior citizen household living without a spouse and income threshold for identifying low-income individuals shall apply where it is impracticable to investigate or inquire, as prescribed in Article 11 of the Act because of the absence of the spouse's personally identifiable information, such as a resident registration number prescribed in Article 7-2 (1) of the Resident Registration Act, alien registration number prescribed in Article 31 (5) of the Immigration Act, and registration number for the registration of real estate assigned under Article 49 (1) 2 of the Registration of Real Estate Act.  <Amended on Jun. 27, 2017; Aug. 28, 2018; Mar. 26, 2019>(4) The income threshold and income threshold for identifying low-income individuals for the relevant year shall be determined and publicly notified by the Minister of Health and Welfare and shall apply from January 1 to December 31.  <Amended on Mar. 26, 2019>(5) In determining the income threshold and income threshold for identifying low-income individuals pursuant to paragraph (1), the Minister of Health and Welfare shall consult with heads of related central administrative agencies, including the Minister of Strategy and Finance.  <Amended on Mar. 26, 2019>Article 5 (Persons Excluded from Eligibility for Basic Pensions) "Person prescribed by Presidential Decree" in Article 3 (3) of the Act, with the exception of its subparagraphs, means any of the following persons:  <Amended on Aug. 28, 2018>1. Any of the following persons who have received a pension stipulated in Article 3 (3) 1 of the Act:(a) A person who has received a retirement pension in lump sum or retirement pension in lump sum after deduction;(b) A person for whom five years have not passed since receiving the lump-sum payment for disability, lump-sum payment for disability for reasons other than official duties, or lump-sum payment for non-service disability;(c) A person for whom five years have not passed since receiving the lump-sum retirement pension for survivors or lump-sum payment on retirement for survivors;2. Any of the following persons who have received a pension stipulated in Article 3 (3) 2 of the Act:(a) A person who has received a retirement pension in lump sum or retirement pension in lump sum after deduction;(b) A person who has received a survivor's pension in lump sum for whom five years have not passed since receiving the survivor's pension in lump sum.3. Any of the following persons who have received a pension stipulated in Article 3 (3) 3 of the Act:(a) A person who has received a retirement pension in lump sum or retirement pension in lump sum after deduction;(b) A person who has received a survivor's pension in lump sum for whom five years have not passed since receiving the survivor's pension in lump sum.Article 6 (Adjustment of Standard Pension Benefits According to Price Index) Standard pension benefits prescribed in Article 5 (2) of the Act (hereinafter referred to as "standard pension benefits") shall be calculated by adding an amount calculated by multiplying the standard pension benefits of the previous year by the inflation rate of nation-wide consumer price index of the previous year, compared with the year before the previous year to, or deducting the amount calculated as such from, the standard pension benefits of the previous year. In such cases, in applying the inflation rate of the nation-wide consumer price index of the previous year, the inflation rate applied when adjusting the amount pursuant to Article 51 (1) of the National Pension Act shall be considered, pursuant to Article 51 (2) of that Act.Article 7 (Standards for Calculation of Income Redistribution Benefits) (1) The amount calculated on the basis of the amount prescribed in Article 51 (1) 1 of the National Pension Act (referring to the amount applicable as at the time the ground for paying the National Pension occurs; hereinafter the same shall apply) among pension benefits to which a beneficiary of a national pension is entitled pursuant to the main sentence of Article 5 (5) 2 of the Act (hereinafter referred to as "amount of income redistribution benefits"), shall be the amount calculated as specified in attached Table 1.  <Amended on Aug. 28, 2018>(2) The standard amount of pensions which forms the basis for calculating the amount of income redistribution benefits pursuant to the proviso to Article 5 (5) 2 of the Act, shall be as follows:  <Amended on Aug. 28, 2018>1. Where adding or reducing the amount of pension for the beneficiary prescribed in the National Pension Act according to the insurance coverage period prescribed in the National Pension Scheme: The amount classified as follows:(a) Where the insurance coverage period prescribed in the National Pension Scheme exceeds 20 years: An amount calculated by adding the amount calculated by multiplying the amount prescribed in Article 51 (1) 1 of that Act by 50/1000 for every year (if the period is less than one year, each one month shall be counted as 1/12 of a year) exceeding 20 years of insurance coverage period prescribed in the National Pension Scheme to the amount prescribed in Article 51 (1) 1 of the National Pension Act;(b) Where the insurance coverage period prescribed in the National Pension Scheme is less than 20 years: An amount calculated by subtracting an amount calculated by multiplying the amount prescribed in Article 51 (1) 1 of the National Pension Act by 50/1000 for every one year (if the period is less than one year, each one month shall be counted as 1/12 of a year) that falls short of 20 years of insurance coverage period prescribed in the National Pension Scheme from the amount prescribed in Article 51 (1) 1 of the National Pension Act;2. Where paying an amount of a pension is postponed or made early pursuant to the National Pension Act: The amount prescribed in Article 51 (1) 1 of the National Pension Act: Provided, That in any of the following cases. it shall be the amount classified as follows:(a) Where paying the amount of a pension for the relevant annuitant is postponed or made early pursuant to the National Pension Act, where his or her insurance coverage period prescribed in the National Pension Scheme exceeds 20 years: An amount calculated under subparagraph 1 (a);(b) Where paying the amount of a pension for the relevant annuitant is postponed or made early pursuant to the National Pension Act, where his or her insurance coverage period prescribed in the National Pension Scheme is less than 20 years: An amount calculated under subparagraph 1 (b).(3) The amount of income redistribution benefits for an annuitant of a divided pension referred to in Article 64 (2) of the National Pension Act shall be 50 percent (referring to a rate of division if the division of a national pension is separately determined under Article 64-2 (1) of that Act) of the amount calculated by multiplying the amount of income redistribution benefits of a person who was the spouse of the annuitant (hereafter in this paragraph referred to as "spouse") of the divided pension calculated pursuant to paragraph (1) or (2) by the proportion of the period of marriage out of the entire period of participation in National Pension Scheme of the spouse.  <Amended on Dec. 31, 2021>Article 8 (Amount of Income Redistribution Benefits of Eligible Recipients of Multiple Pensions) (1) Where entitlement to at least two pensions falling under subparagraphs of Article 5 (4) of the Act and paragraph (6) of that Article occurs to an eligible recipient of a basic pension, the amount of income redistribution benefits for the relevant eligible recipient of the basic pension shall be calculated by adding the amount calculated pursuant to Article 7 to each amount of entitlement.  <Amended on Aug. 28, 2018>(2) Where entitlement to at least two pensions that constitute the pensions stipulated in the subparagraphs of Article 5 (4) of the Act or paragraph (6) of that Article, a disability pension prescribed in Article 67 of the National Pension Act, or a survivor pension prescribed in Article 72 of that Act occurs to an eligible recipient of a basic pension (including persons who fall under Article 5 (7) 2 (a) of the Act), the amount calculated pursuant to Article 7 for the entitlement to pensions that fall under the subparagraphs of Article 5 (4) of the Act or paragraph (6) of that Article shall be the amount of income redistribution benefits for the relevant eligible recipient of the basic pension.  <Amended on Aug. 28, 2018>Article 9 (Persons to whom Standard Pension Benefits shall be Paid as Basic Pension Benefits) (1) "Persons prescribed by Presidential Decree" in Article 5 (7) 2 (c) of the Act means the recipients defined in subparagraph 2 of Article 2 of the National Basic Living Security Act.  <Amended on Aug. 28, 2018>(2) "Persons prescribed by Presidential Decree" in Article 5 (7) 2 (d) of the Act means any of following persons:  <Amended on Aug. 28, 2018>1. Voluntarily and continuously insured persons prescribed in Article 13 (1) of the National Pension Act;2. Persons who have failed to request divided pension benefits after becoming entitled thereto under Article 64 (1) of the National Pension Act;3. Persons entitled to an aggregate old-age pension, but have chosen entitlement to benefits of the pension for a bereaved family member pursuant to Article 18 (2) 1 (b) of the Act on Aggregation of National Pension and Occupational Pensions.Article 10 (Detailed Standards for Calculation of Basic Pension Benefits Based on National Pension Benefits) The basic pension benefits payable to a person who falls under Article 6 (2) of the Act (hereinafter referred to as "basic pension benefits") shall be the greater of the following amounts:  <Amended on Aug. 28, 2018>1. An amount calculated by subtracting the following amounts from the amount that is 250/100 of the standard pension benefits:(a) The amount of pensions for an eligible recipient referred to in subparagraphs of Article 5 (4) of the Act (where he or she receives dependent pension benefits pursuant to Article 52 of the National Pension Act, the amount excluding such benefits shall apply);(b) The total amount of the aggregate old-age pension prescribed in Article 11 of the Act on Aggregation of National Pension and Occupational Pensions (where he or she receives dependent pension benefits prescribed in Article 52 of the National Pension Act, an amount excluding such benefits shall apply) and the amount of aggregate retirement pension prescribed in Article 12 of that Act;2. Basic pension benefits calculated pursuant to Article 5 of the Act (where the basic pension benefits calculated pursuant to Article 5 of the Act exceed standard pension benefits, standard pension benefits shall apply).Article 11 (Level of Payment of Basic Pension Benefits after Reduction) (1) For a person in whose case the total of assessed income and basic pension benefits exceeds the income threshold as prescribed in Article 8 (2) of the Act, an amount classified as follows shall be paid within the upper limit of basic pension benefits calculated in accordance with Articles 5, 5-2, 6 and 7 of the Act:  <Amended on Aug. 28, 2018; Mar. 26, 2019>1. Where the amount calculated by subtracting the assessed income from the income threshold does not exceed 10/100 of the standard pension benefits: An amount equivalent to 10/100 of the standard pension benefits;2. Where the amount calculated by subtracting the assessed income from the income threshold exceeds 10/100 of the standard pension benefits: An amount obtained by subtracting the assessed income from the income threshold.(2) Notwithstanding paragraph (1), where both the principal and his or her spouse are eligible recipients of basic pensions and the total of basic pension benefits of the principal and his or her spouse after reduction prescribed in Article 8 (1) of the Act exceeds the income threshold, they shall be paid an amount classified as follows within the upper limit of the total of the basic pension benefits of the principal and his or her spouse reduced pursuant to Article 8 (1) of the Act:  <Amended on Aug. 28, 2018>1. Where the amount calculated by subtracting the assessed income from the income threshold does not exceed 20/100 of the standard pension benefits: An amount equivalent to 20/100 of the standard pension benefits;2. Where the amount calculated by subtracting the assessed income from the income threshold exceeds 20/100 of the standard pension benefits: An amount calculated by subtracting the assessed income from the income threshold.(3) Where the amount obtained by adding the assessed income of an eligible recipient of a basic pension who falls under Article 5-2 of the Act to his or her basic pension benefits exceeds the amount obtained by adding the assessed income of an eligible recipient of a basic pension who does not fall under Article 5-2 of the Act to his or her basic pension benefits, the amount obtained by subtracting the excess from the basic pension benefits of the eligible recipient of a basic pension shall be paid, in accordance with Article 8 (3) of the Act.  <Newly Inserted on Mar. 26, 2019>(4) Notwithstanding paragraph (3), where a person and his or her spouse are both eligible recipients of a basic pension under Article 5-2 of the Act and where the amount obtained by adding their assessed income to their basic pension benefits reduced under Article 8 (1) of the Act exceeds the amount obtained by adding the income threshold for identifying low-income individuals to the amount obtained by multiplying the standard pension benefits of an eligible recipient who does not fall under Article 5-2 by 160/100, the amount obtained by subtracting the excess from the sum of the basic pension benefits of the recipient and his or her spouse shall be paid.  <Newly Inserted on Mar. 26, 2019>(5) The amount payable pursuant to paragraph (2) or (4) shall be distributed to both of the principal and his or her spouse in proportion to the amount of their basic pension benefits reduced pursuant to Article 8 (1) of the Act: Provided, That where the amount payable to either the principal or his or her spouse under paragraph (2) is less than 10/100 of the standard pension benefits, an amount equivalent to 10/100 of the standard pension benefits shall be paid, notwithstanding paragraph (2).  <Amended on Aug. 28, 2018; Mar. 26, 2019>Article 12 (Evaluation of Appropriateness of Basic Pension Benefits) (1) In order to evaluate appropriateness of basic pension benefits prescribed in Article 9 (1) of the Act (hereinafter referred to as "evaluation of appropriateness"), the Minister of Health and Welfare shall formulate a plan for the evaluation of appropriateness by no later than May 31 of the year immediately preceding the year when appropriateness is to be evaluated.(2) The Minister of Health and Welfare shall conduct a fact-finding survey on the poverty of senior citizens and the prospect of long-term financial requirements of basic pensions by no later than March 31 of the year when appropriateness is to be evaluated pursuant to Article 9 (2) of the Act.(3) The Minister of Health and Welfare shall evaluate appropriateness by no later than September 30 of the year when appropriateness is to be evaluated.(4) The standard pension benefits adjusted pursuant to Article 9 (1) of the Act after appropriateness is evaluated, shall apply from January 1 of the year following the evaluation of appropriateness.Article 13 (Methods and Procedures for Applying for Payment of Basic Pensions) (1) A person who intends to apply for the payment of a basic pension pursuant to Article 10 (1) of the Act shall submit an application for the payment of a basic pension prescribed by Ordinance of the Ministry of Health and Welfare to a Special Self-Governing City Mayor, a Special Self-Governing Province Governor (excluding a Do Governor of a Special Self-Governing Province which has a Si/Gun which is a local government located within its jurisdiction; hereinafter the same shall apply), or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter the same shall apply), along with the following documents,  <Amended on Dec. 31, 2021; Jan. 23, 2024>1. A report on his or her income and property;2. A written consent to the provision of financial information, credit information, or insurance information (including a written consent of his or her spouse);3. A document prescribed by Ordinance of the Ministry of Health and Welfare for verifying the identification of a person who intends to receive a basic pension (hereinafter referred to as "basic pension applicant");4. A letter of attorney, and a document prescribed by Ordinance of the Ministry of Health and Welfare for verifying the personal information of his or her agent (limited to where an agent files the application).(2) Where a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu who has no jurisdiction over the domicile of a basic pension applicant receives an application for payment of basic pensions, he or she shall send the relevant documents to the Special Self-Governing City Mayor, Special Self-Governing Province Governor, or the head of a Si/Gun/Gu without delay.  <Newly Inserted on Dec. 31, 2021>(3) A public official of a Special Self-Governing City, a Special Self-Governing Province (excluding a Special Self-Governing Province which has a Si/Gun which is a local government located within its jurisdiction; hereinafter the same shall apply), or Si/Gun/Gu (referring to an autonomous Gu; hereinafter the same shall apply) may file an application in lieu of the payment of a basic pension for a person who lives alone with difficulty in mobility, among persons who wish to receive a basic pension having domicile in his or her jurisdiction. In such cases, the consent of the persons who wish to receive a basic pension shall be obtained.  <Amended on Dec. 31, 2021; Jan. 23, 2024>(4) Upon receipt of an application for payment of basic pensions pursuant to paragraph (1) or (3), a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall prepare a basic pension application register, and verify the family relation certificate, the certificate of registration of buildings, and the certificate of registration of land, among documents related to the income and property of the basic pension applicant, through administrative data matching prescribed in Article 36 (1) of the Electronic Government Act: Provided, That if the basic pension applicant refuses to give consent to the verification, he or she shall require the applicant to attach such documents.  <Amended on Dec. 31, 2021>Article 13-2 (History Management of Applicants for Receipt of Basic Pensions) (1) A basic pension applicant who has applied for a basic pension pursuant to Article 10 of the Act but is unentitled to the basic pension, may have his or her possibility to be included in the scope of eligible recipients of basic pensions prescribed in Article 3 of the Act verified by the Special Self-Governing City Major, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu.(2) A person who intends to be included in the scope of eligible recipients of basic pensions prescribed in Article 3 of the Act verified pursuant to paragraph (1) (including an agent prescribed by Ordinance of the Ministry of Health and Welfare under Article 10 (1) of the Act), shall prepare and submit an application in the form prescribed by Ordinance of the Ministry of Health and Welfare to the Special Self-Governing City Major, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu.(3) The Special Self-Governing City Major, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall verify the entitlement of a basic pension applicant who has submitted an application pursuant to paragraph (2) (hereinafter referred to as "applicant for managing entitlement to a basic pension") to be included in the scope of eligible recipients of basic pensions prescribed in Article 3 of the Act as at the time that falls under any item of Article 15 (2) 2.(4) If an applicant for managing entitlement to a basic pension is verified to have the possibility to be included in the scope of eligible recipients of basic pensions prescribed in Article 3 of the Act, as the result of verification conducted under paragraph (3), the Special Self-Governing City Major, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall guide the applicant for managing possibility of receiving a basic pension (including an agent prescribed by Ordinance of the Ministry of Health and Welfare under Article 10 (1) of the Act) about the methods and procedures for applying for a basic pension pursuant to Article 13.(5) The period for validity of an application submitted pursuant to paragraph (2) shall be prescribed by Ordinance of the Ministry of Health and Welfare by up to five years, and the criteria for the possibility of an applicant for managing entitlement to a basic pension to be included in the scope of eligible recipients of basic pensions prescribed in Article 3 of the Act, shall be determined and publicly notified by the Minister of Health and Welfare.[This Article Newly Inserted on Nov. 30, 2015]Article 14 (Scope of Financial Information) (1) "Data or information prescribed by Presidential Decree" in Article 10 (2) 1 through 3 means the following data or information:  <Amended on Jul. 26, 2016>1. Financial information prescribed in Article 10 (2) 1 of the Act:(a) Demand deposits, such as ordinary deposits, savings deposits, and free savings deposits: Average balance within three months;(b) Savings deposits, such as time deposits, term deposits, and term savings: Balance or gross deposits;(c) Stocks, beneficiary certificates, investments, and investment shares: The latest market value. In this regard, the latest market value of unlisted stocks shall be the amount assessed by applying mutatis mutandisArticle 54 (1) of the Enforcement Decree of the Inheritance Tax and Gift Tax Act;(d) Bonds, bills, checks, certificates of obligation, and certificates of preemptive right to new stocks: Par value;(e) Annuity savings: The amount paid regularly or the final balance;(f) Interest and dividends or discounts accruing from financial assets that fall under items (a) through (e);2. Credit information prescribed in Article 10 (2) 2 of the Act:(a) Loan status and details of the amount in arrears;(b) Amount due by credit cards;3. Insurance information prescribed in Article 10 (2) 3 of the Act:(a) Insurance policies: The amount to be refunded if canceled, or insurance money paid within the recent year;(b) Annuity insurance: The amount to be refunded if canceled, or the amount to be paid regularly.(2) Details of the financial information, credit information or insurance information prescribed in subparagraphs of paragraph (1) (hereinafter referred to as "financial information, etc.") shall be as specified in a plan for investigations and inquiries referred to in Article 15 (3).Article 14-2 (Provision of Information Related to Basic Pensions) (1) Information related to basic pensions that the Minister of Health and Welfare, the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall provide pursuant to Article 10-2 (1) of the Act shall be as follows:1. Scope of eligible recipients of basic pensions prescribed in Article 3 of the Act;2. Methods for calculating, etc. basic pensions prescribed in Article 5 of the Act;3. Methods, procedures, etc. for applying for payment of basic pensions prescribed in Article 10 of the Act.(2) Pursuant to Article 10-2 (1) of the Act, the Minister of Health and Welfare, the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall provide persons aged 65 or older with basic pension-related information on the matters prescribed in subparagraphs of paragraph (1) through such means as websites, newspapers defined in items of subparagraph 1 of Article 2 of the Act on the Promotion of Newspapers or broadcasting defined in items of subparagraph 1 of Article 2 of the Broadcasting Act, etc.(3) In addition to providing information prescribed in paragraph (2), the Minister of Health and Welfare, the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may provide persons who reach 65 years old with basic pension-related information on the matters prescribed in subparagraphs of paragraph (1) through such means as documents, telephone, facsimile, etc., as necessary.[This Article Newly Inserted on Jul. 26, 2016]Article 15 (Scope and Timing of Investigations and Inquiries) (1) The scope of investigations and inquiries to be conducted pursuant to Article 11 (1) of the Act shall be as follows:  <Amended on Nov. 30, 2015>1. Investigations and inquiries upon application: Investigations and inquiries for determining the eligibility for basic pensions of a basic pension applicant and his or her spouse who have applied for basic pensions pursuant to Article 10 (1) of the Act and the basic pension benefits;2. Inspection of and inquiry into verification: Inspection and inquiry falling under any of the following:(a) Investigations and inquiries for verifying the matters reported pursuant to Article 18 (1) of the Act;(b) Ex officio investigations and inquiries for verifying entitlement to a basic pension of an eligible recipient of a basic pension, a recipient of a basic pension, and their respective spouses, or any change in their basic pension benefits;3. Investigations and inquiries for verifying entitlement to a basic pension of an applicant for managing possibility of receiving a basic pension and his or her spouse.(2) The investigations and inquiries referred to in paragraph (1) shall be conducted during the following periods:  <Amended on Nov. 30, 2015>1. Investigations and inquiries upon application: When an application for a basic pension prescribed in Article 10 (1) of the Act is filed;2. Investigations and inquiries for verification: At any of the following timing:(a) When a report prescribed in Article 18 (1) of the Act is filed;(b) At the time specified in a plan for investigations and inquiries conducted under paragraphs (3) and (4) as the timing for conducting investigations and inquiries for verification;3. Investigations and inquiries on an applicant for managing entitlement to a basic pension: At any of the following timing:(a) At the time when the Minister of Health and Welfare publicly notifies the income threshold pursuant to Article 3 (1) of the Act;(b) At the time when any matter determined and publicly notified by the Minister of Health and Welfare as necessary to verify the possibility of receiving a basic pension occurs to an applicant for managing possibility of receiving a basic pension.(3) In order to conduct investigations and inquiries pursuant to paragraph (1) 2 (b), the Minister of Health and Welfare shall formulate an annual plan for investigations and inquiries, including the following matters:1. Basic direction-setting for investigations and inquiries;2. The scope, details, and timing for investigations and inquiries, and the procedures therefor;3. A plan for establishing a cooperation system to conduct investigations and inquiries;4. Matters concerning the details, etc. of financial information, etc. necessary to perform the affairs related to a request for and providing financial information, etc.;5. Other matters necessary to verify the income and property of a recipient of a basic pension, an eligible recipient of a basic pension, and their respective spouses.(4) The Sp
